Administrative Law Judge Issues Initial Determination in Patent Infringement Complaint filed by Qualcomm with the ITC

SAN DIEGO, Dec. 12 /PRNewswire-FirstCall/ -- Qualcomm Incorporated (Nasdaq: QCOM), a leading developer and innovator of advanced wireless technologies and data solutions, today announced that Administrative Law Judge Paul J. Luckern made an initial determination (ID) that Nokia's GSM/GPRS/EDGE-only handsets (i.e., GSM/GPRS/EDGE handsets that do not also implement WCDMA) do not infringe three Qualcomm patents. A complaint was filed by Qualcomm against Nokia with the International Trade Commission (ITC) in June 2006.

Qualcomm contends that Nokia imports cellular handsets into the United States that infringe these particular Qualcomm patents covering certain power control technologies and is seeking an exclusion order barring the importation of infringing Nokia handsets that use that technology. Under applicable ITC rules, Qualcomm intends to petition the Commission for review of the ID. A final ruling by the ITC is scheduled to be issued by April 14, 2008. The action does not address Nokia's WCDMA or "3G" products and the ID therefore has no bearing on such products.
